President Trump’s lawyer Rudy Giuliani said Saturday that the president’s legal team has warned Trump’s former longtime personal attorney Michael Cohen against speaking about the president, claiming that he has violated attorney-client privilege.
“We’ve indicated to them that they should respect the client and attorney privilege in different ways,” Giuliani told ABC News.
“We have complained to them that he’s violated the attorney-client privilege, publicly and privately,” he added.
Shortly after Giuliani’s comments, Lanny Davis, Cohen’s lawyer and a columnist for The Hill, called Trump’s attorney “confused.”
“Mr. Giuliani seems to be confused. He expressly waived attorney client privilege last week and repeatedly and inaccurately — as proven by the tape —talked and talked about the recording, forfeiting all confidentiality,” Davis said in a statement to The Hill.
Giuliani’s comments come after CNN reported that Cohen is reportedly ready to tell special counsel Robert Mueller that then-candidate Trump approved a 2016 Trump Tower between a Russian lawyer and Trump campaign officials, including his son, Donald Trump Jr.
Giuliani called Cohen a “pathological liar” following the report and maintained that Trump was not aware of the meeting. Trump and others, including Trump Jr., have asserted that the president didn’t know of the meeting until The New York Times reported on it in July 2017.
Cohen also made secret recordings of private conversations between him and Trump, including one discussing buying the rights to former Playboy model Karen McDougal’s story about her alleged affair with Trump.
CNN obtained a copy of that tape from Cohen’s lawyer, Lanny Davis, and aired the audio last week.
Giuliani told ABC News that Trump’s legal team has hired experts to review the recordings made by Cohen. Giuliani also said Trump’s lawyers are investigating why the tape of the conversation about the payment tied to McDougal cut off part of the way through the discussion.
“We’ve had it analyzed and there’s no way to tell if he did it at the time or if he went back and edited out a portion, because it goes on to another subject and stops abruptly,” Giuliani told the network.
The lawyer added that the joint defense agreement between Trump and Cohen has ended, after Cohen hired lawyer Guy Petrillo in July.
“Usually you don’t discuss joint defense agreements, but i think it’s obvious there’s been so much public discussion that there isn’t one right now,” Giuliani said. “We wouldn’t consider it in our best interest to share confidential information with them and they would feel the same way.”
